ShakeFit Terms of Use

These Terms of Use ("Terms") are the licence agreement between you and Foo AI Corp. ("we", "us") for the ShakeFit application ("ShakeFit", "the app"). They are also the End User Licence Agreement for the app on the Apple App Store.

By downloading or using ShakeFit you accept these Terms. If you do not accept them, do not use the app.

1. Why these Terms exist instead of Apple's standard licence

Apple offers a standard End User Licence Agreement that developers may link instead of writing their own. We use these custom Terms because three things that matter for ShakeFit are absent from the standard agreement and cannot be added to it.

1. Health and safety. ShakeFit asks you to move your body at a tempo, and it grades that movement. Assumption of risk, the instruction to stop when something hurts, and the statement that ShakeFit is not a medical device are the terms with the most practical weight for this product. The standard licence has no health clause.
2. Camera and computer vision. The app runs pose estimation on your camera feed. The scope of that processing, and the fact that no video is retained, belong in the contract and not only in a privacy notice.
3. What a score means. Grades, calorie figures, muscle volume and body composition values are estimates produced by a model. Saying so in the licence is what keeps a game score from being read as a measurement.

These Terms include the minimum terms Apple requires of a custom licence agreement. Sections 3, 12, 14, 15, 16, 17, 18 and 19 carry those requirements.

2. What ShakeFit is

ShakeFit is a rhythm workout game. Your phone camera watches you, an on-device model estimates your body pose, and the app scores each repetition against the beat and against a range of motion it calibrates from your own first repetitions. Sessions are built from tracks with music and a coach voice.

ShakeFit is entertainment and general fitness software.

• It is not a medical device. It does not diagnose, treat, cure or prevent any condition, and it does not give medical advice.
• Grades (PERFECT, GREAT, GOOD, COACH), scores, combos, XP and levels are game outputs, not clinical assessments of your form.
• Calorie figures, weekly muscle volume and body composition values are estimates calculated from the numbers you enter and from what the camera can observe. The app labels them as estimates and describes their limits where it shows them.
• Where the app cannot measure something reliably with a single front-facing camera, it does not claim to measure it.

3. Licence

We grant you a personal, non-transferable, non-exclusive licence to use ShakeFit on any Apple-branded device that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including Family Sharing where Apple makes it available. The licence covers use of the app, not ownership of it.

You may not, except where the law expressly allows it:

• copy, sell, rent, sublicense or redistribute the app or its content,
• reverse engineer, decompile or disassemble the app, or attempt to extract its source code, models or bundled assets,
• extract the music, coach voice, guide motion data or other assets for use outside the app,
• bypass or interfere with the free and paid content boundary, the age gate, or any technical measure in the app,
• automate, script or simulate input in order to generate scores or records that you did not perform,
• use the app in a way that breaks the law or interferes with other people's use of it.

4. Health, safety and your own risk

Exercise carries risk of injury. You decide whether you are fit to exercise, and you exercise at your own risk.

The app shows these notices before your first session, and they are part of these Terms.

• This app is not a medical device and does not diagnose or treat.
• If you have a condition or are new to exercise, consult a doctor first.
• Stop immediately if you feel pain or dizziness.

You also agree to the following.

• Clear enough space around you for the movements in the session, and check the floor and the ceiling height before you start.
• Stop if you feel pain, dizziness, shortness of breath or any other warning sign, and seek medical attention when appropriate.
• Do not treat a high grade as confirmation that a movement is safe for your body, and do not treat a low grade as a diagnosis.
• Use the low impact setting, the silent mode and the reduced motion setting when they suit you better.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under the law that applies to you.

5. Camera, and other people in the room

ShakeFit needs camera access to score movement. Camera frames are processed on your device by the on-device pose model and are discarded immediately. The app has no code that writes video to storage or sends it over a network. Nothing you record is created, because nothing is recorded. The privacy policy at https://shakefit.app/privacy explains this in detail.

You are responsible for what your camera points at. If other people are in the room, be considerate, and be aware that the phone screen shows a live preview even though nothing is saved.

6. Age

You must be at least 13 years old to use ShakeFit. The app asks for your date of birth once, keeps only your age in years, and blocks the app permanently if you are under the minimum age.

If the country where you live sets a higher minimum age for using an online service without the consent of a parent or legal guardian, you may use ShakeFit only if you meet that age or have that consent. Parents and guardians who believe a child under the minimum age has used the app can write to contact@shakefit.app.

7. Free content and ShakeFit Plus

ShakeFit includes free content: one representative track in each of the five genres, five tracks in total. The rest of the track library and the deeper data views are part of the ShakeFit Plus subscription.

If you subscribe to ShakeFit Plus, the following applies.

• Purchase and billing. The subscription is sold through the Apple App Store and billed to your Apple Account. The price, the billing period and any introductory offer are the ones shown to you in the app and on the App Store page at the moment of purchase. We do not receive or handle your payment details.
• Free trial. Where a free trial is offered, it converts into a paid subscription unless you cancel at least 24 hours before the trial ends.
• Automatic renewal. The subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within 24 hours before the period ends.
• Cancelling. Cancel at any time in the Apple Account subscription settings on your device. Cancelling stops future renewals. It does not shorten the period you have already paid for, and you keep Plus content until that period ends.
• Price changes. Apple notifies you of a price increase and asks for your consent as required by the App Store rules. If you do not consent, the subscription does not renew at the new price.
• Restoring. Use "Restore purchases" in the app to recover an active subscription on a new device or after reinstalling.

8. Refunds

Purchases are made through Apple, so refunds are handled by Apple under Apple's Media Services Terms and Conditions. Request a refund at https://reportaproblem.apple.com. We cannot issue a refund ourselves because the payment never reaches us.

This does not limit any statutory right you have. In particular:

• Rights you have under mandatory consumer law in your country of residence, including any statutory right of withdrawal, apply regardless of these Terms.
• Where a person without full legal capacity, such as a minor, made a purchase without the consent of their legal representative, the purchase can be cancelled under the law that applies. Send the request to Apple, and write to contact@shakefit.app if you need us to support it. We will cooperate with Apple's process.
• If ShakeFit Plus is unusable because of a fault on our side, tell us at contact@shakefit.app. We will fix it or support your refund request with Apple.

9. Your records

Your profile, session history, weight log, body measurements, settings and progress are stored on your device. You can see how many records exist and delete all of them in the app, under Profile then Data. Deletion is immediate and cannot be undone.

We do not claim ownership of anything you enter. The privacy policy describes exactly which summary values leave the device when server sync is switched on, how long they are kept, and how to have them deleted.

10. Content in the app, and content we license from others

The ShakeFit name, wordmark, app icon, interface, session and track design, guide figures, coach lines, and the judgment engine are ours or our licensors'. These Terms give you no rights in them beyond using the app.

ShakeFit ships third-party material under the licences listed below. Where a licence requires attribution, this list and the "Data sources" screen in the app are that attribution.

The original videos and datasets are not redistributed with the app. Only derived numeric pose coordinates are included.

11. Availability and changes to the app

We may add, change or remove features, tracks and content. We may stop offering ShakeFit or a part of it. If we stop offering ShakeFit Plus, or remove content that you paid for in a way that materially reduces what you bought, we will give notice in the app and you may cancel; refunds for a period already paid follow section 8.

The app works without an email address or password, and without a network connection. Features that depend on a network, and the optional server sync described in the privacy policy, may be unavailable at times.

12. Support

Support is our responsibility, not Apple's. Apple has no obligation to provide any maintenance or support for ShakeFit. Write to contact@shakefit.app. We aim to answer within 3 business days.

13. Changes to these Terms

We may change these Terms when the app changes or the law changes. We will publish the new version at https://shakefit.app/terms with a new version number and date, and we will give notice in the app at least 7 days before it takes effect. If a change is to your disadvantage, we will give notice at least 30 days before it takes effect.

If you do not accept a change, stop using the app and cancel any subscription before the change takes effect. Continuing to use the app after that date means you accept the new version.

14. Warranty

We provide ShakeFit with reasonable care and skill. To the extent the law allows, and except for the statutory guarantees you have as a consumer, the app is provided as it is, without a warranty that it will be uninterrupted, error free, or that a grade or an estimate will be accurate.

Any warranty obligation for the app is ours alone, not Apple's. If ShakeFit fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility.

15. Liability

We are liable for damage we cause intentionally or negligently, as provided by the law that applies to you. Nothing here excludes liability for death or personal injury caused by our negligence, for intent or gross negligence, or any liability that cannot be excluded or limited by law.

Where liability can be limited by law, our total liability for all claims arising in any 12 month period is limited to the amount you paid us for ShakeFit Plus in the 12 months before the event that caused the claim, and we are not liable for loss of profit, loss of data that you could have prevented by using the app's own records, or other indirect or consequential loss.

16. Claims about the product

We, and not Apple, are responsible for addressing any claim by you or a third party relating to ShakeFit or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims under consumer protection or privacy law, and claims arising from the health and fitness nature of the app.

17. Intellectual property claims

If a third party claims that ShakeFit or your permitted use of it infringes their intellectual property rights, we, and not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.

18. Apple as third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and may enforce them against you as a user. These Terms are between you and us only. Apple is not a party to them.

19. Legal compliance and export

You confirm that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a terrorist supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties. You will comply with all applicable export control laws when using ShakeFit.

20. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without prejudice to the following.

• If you are a consumer, you keep the protection of the mandatory consumer law of your country of residence, and you may bring proceedings in the courts of the place where you live.
• For claims we bring against a consumer, we will use the court with jurisdiction over the consumer's place of residence.
• Where no consumer forum rule applies, the courts of Seoul, Republic of Korea, have jurisdiction.

Before starting proceedings, please write to contact@shakefit.app so we can try to resolve the matter directly. In Korea you may also bring the matter to the Korea Consumer Agency or a consumer dispute mediation committee.

21. General

If a provision of these Terms is invalid, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the privacy policy and the health data notice, are the whole agreement between you and us about ShakeFit.
